  • remove the affected product; or
  • cancel and refund the affected part of the order.

This clause will not be applied in a way that unlawfully overrides consumer rights or permits misleading pricing.

Where payment has already been received for an order we cannot accept, the relevant amount will be refunded.

Taan’s Tuine does not need to receive or store complete card details where those details are processed directly by the payment provider.

16. Failed or Reversed Payments

If payment fails, is declined, reversed, disputed or cannot be verified:

  • the order may not be processed;
  • fulfilment may be suspended;
  • we may contact you for clarification;
  • the order may be cancelled; or
  • amounts lawfully owing may remain payable.

You should not send card numbers, passwords, one-time PINs or other sensitive payment credentials through email, contact forms or WhatsApp.

Payment problems should be resolved through the secure payment process or directly with the relevant financial institution or payment provider.

17. Discount Codes and Promotions

Discount codes and promotions are subject to the conditions communicated with the relevant offer.

Unless stated otherwise:

Taan’s Tuine intends to deliver within South Africa.

Orders may be delivered using The Courier Guy or another approved delivery provider available through the website.

Delivery may be restricted where:

  • the address falls outside an available delivery area;
  • the courier cannot safely or reasonably service the address;
  • the address is incomplete or incorrect;
  • the product cannot be delivered through the selected service; or
  • another reasonable logistical restriction applies.

Available delivery methods and charges will be displayed during checkout where technically possible.

19. Delivery Charges

Delivery charges may depend on factors such as:

  • delivery address;
  • parcel dimensions or weight;
  • courier rates;
  • selected delivery method;
  • remote-area charges;
  • promotional offers;
  • free-delivery thresholds; and
  • the products included in the order.

The delivery charge shown and accepted during checkout will ordinarily apply to the order.

Where an incorrect or incomplete address causes additional courier charges, the customer may be responsible for reasonable additional costs where permitted by law.

20. Preparation and Delivery Estimates

The working operational information supplied by the client indicates approximately two working days for order preparation and an estimated delivery period of two to five working days thereafter. Unless expressly guaranteed in writing, processing and delivery periods are estimates rather than fixed deadlines.

Ownership will ordinarily pass to the customer once:

24. Returns, Refunds and Cancellations

The Refunds and Returns Policy forms part of these Terms and Conditions.

Where applicable law gives a customer stronger rights than a provision of the policy or these Terms, the applicable law will prevail.

26. Landscaping and Service Enquiries

Unless expressly stated otherwise:

The National Consumer Commission is the regulatory body established under the Consumer Protection Act to protect consumer interests and facilitate redress.

42. Governing Law and Jurisdiction

These Terms and Conditions and transactions concluded through the website are governed by South African law.

Subject to mandatory consumer rights regarding jurisdiction and dispute resolution, any dispute may be dealt with by a competent South African court or other legally authorised forum.

Nothing in this clause prevents a consumer from using a forum or remedy available under applicable consumer legislation.

43. Severability

If a provision of these Terms and Conditions is found to be unlawful, invalid or unenforceable:

  • that provision will be interpreted or limited to the minimum extent necessary to make it enforceable where possible; or
  • it will be treated as separate from the remaining provisions.

The remaining Terms and Conditions will continue to apply.

44. No Waiver

If Taan’s Tuine does not immediately enforce a provision of these Terms and Conditions, this does not mean that the provision has been waived.

A waiver will apply only where it is clearly communicated and will not automatically apply to a later breach.

45. Entire Agreement

These Terms and Conditions, together with the policies and information incorporated into them, constitute the general agreement governing website use and online purchases.
